Terms of Service

1. Acceptance of these Terms

These Terms of Service (the “Terms”) govern your access to and use of the website located at hiddenstatsstudio.com and any related pages, content, and features we operate (together, the “Site”). The Site is provided by Hidden Stats Studio LLC (“Hidden Stats Studio,” “we,” “us,” or “our”). By accessing or using the Site, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Site.

2. Who we are & definitions

Hidden Stats Studio is an independent game development studio. “Content” means text, images, logos, artwork, audio, video, software, and other materials made available on or through the Site. “You” means the individual or entity accessing the Site. Our games are separate products that may be distributed through third-party platforms and are governed by their own terms (see Section 10).

3. Eligibility & age

The Site is intended for a general audience and is not directed to children. You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction, which may be higher) to use the Site. If you are under the age of majority where you live, you may use the Site only with the involvement of a parent or legal guardian. By using the Site you represent that you meet these requirements. If you use the Site on behalf of an organization, you represent that you are authorized to accept these Terms for it.

4. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above and, for material changes, take reasonable steps to notify you (for example, a notice on the Site). Changes are effective when posted. Your continued use of the Site after changes take effect constitutes acceptance of the revised Terms. If you do not agree to a change, stop using the Site.

5. Your license to use the site

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and view the Site for your personal, non-commercial use. This license does not include any right to: (a) resell or make commercial use of the Site or its Content; (b) copy, reproduce, distribute, publicly display, or create derivative works from the Site except as expressly permitted (including the creator license in Section 7); (c) use any data mining, robots, scraping, or similar data gathering tools; (d) frame or mirror any part of the Site; or (e) use the Site in any way that violates these Terms or applicable law.

6. Intellectual property

The Site and all Content, including the “Hidden Stats Studio” name and logo, game titles, characters, artwork, and other trademarks and copyrighted works, are owned by or licensed to Hidden Stats Studio and are protected by intellectual-property and other laws. Except for the limited licenses expressly granted in these Terms, we reserve all rights. Nothing in these Terms transfers any ownership to you. You may not remove, obscure, or alter any proprietary notices.

7. Content creators & streaming

We love that people make videos, streams, and other content featuring our games. Subject to these Terms and the guidelines on our Content Creators page, we grant individual creators a personal, limited, non-exclusive, revocable, worldwide license to capture and share gameplay footage, screenshots, and streams of our games, including on platforms such as YouTube, Twitch, and similar services, and you may monetize that content through those platforms’ standard monetization programs. In exchange, you agree:

  • not to imply that your content is official, sponsored, or endorsed by, or affiliated with, Hidden Stats Studio without our prior written permission;
  • not to distribute or make available our game files, builds, assets, or unreleased/embargoed materials except as we expressly allow;
  • not to use our logos, key art, or other brand assets except as permitted on the Content Creators page or a media kit, and always in accordance with any brand guidelines we provide;
  • to comply with the platform’s terms and applicable law, and to add your own substantial commentary or creative contribution rather than simply re-uploading our content;
  • not to use our games or content to create material that is unlawful, hateful, harassing, or otherwise objectionable, or that infringes any third party’s rights (including third-party music that may trigger platform copyright claims).

This creator license does not cover any third-party content (such as licensed music) that may be included in our games; you are responsible for your use of such content. We may modify, suspend, or revoke this license, in whole or in part and at any time, including where content violates these Terms. This Section grants a license only and does not create any partnership, employment, or agency relationship.

8. Your submissions & feedback

If you send us ideas, suggestions, feedback, or other materials (“Submissions”) — for example through a contact form or by email — you grant Hidden Stats Studio a perpetual, irrevocable, worldwide, royalty-free, sublicensable license to use, reproduce, modify, and incorporate the Submission for any purpose, without any obligation to compensate you or to keep it confidential. Please do not send us anything you consider confidential or proprietary. You represent that you own or control the rights to your Submissions and that they do not violate these Terms or any law.

9. Acceptable use

You agree not to, and not to attempt to:

  • use the Site for any unlawful, fraudulent, or harmful purpose;
  • interfere with or disrupt the Site, its servers, or networks, including by transmitting malware or launching denial-of-service attacks;
  • attempt to gain unauthorized access to any part of the Site, other users’ data, or our systems;
  • probe, scan, or test the vulnerability of the Site except under a program we authorize in writing;
  • impersonate any person or misrepresent your affiliation with any person or entity;
  • infringe our or any third party’s intellectual-property, privacy, or other rights;
  • use the Site to collect or harvest personal information about others.

10. Games have their own terms

These Terms cover the Site only. Our games and any related online services, downloadable content, or accounts are separate products governed by their own end-user license agreements, terms of service, and privacy notices, which may be presented on separate game websites or distribution platforms. In the event of a conflict, the game-specific terms govern your use of that game.

11. Third-party links & services

The Site may link to third-party websites, platforms, or services that we do not control (for example, social media, storefronts, or streaming platforms). We provide these links for convenience and do not endorse and are not responsible for third-party content, products, or practices. Your use of third-party services is governed by their terms and privacy policies.

12. Copyright & DMCA policy

We respect intellectual-property rights and expect users to do the same. If you believe content on the Site infringes your copyright, you may send a notice under the Digital Millennium Copyright Act (DMCA) to our designated agent that includes: (a) your physical or electronic signature; (b) identification of the copyrighted work claimed to be infringed; (c) identification of the material you claim is infringing and its location on the Site; (d) your contact information; (e) a statement that you have a good-faith belief the use is not authorized; and (f) a statement, under penalty of perjury, that the information is accurate and that you are the owner or authorized to act on the owner’s behalf.

Designated DMCA agent: not yet formally designated — for now, send copyright notices to contact@hiddenstatsstudio.com. (Before launch we recommend registering a designated agent with the U.S. Copyright Office.) We may remove allegedly infringing material, forward notices, and terminate access for repeat infringers. If your material was removed and you believe it was a mistake or misidentification, you may submit a counter-notice with the information required by the DMCA.

13. Disclaimers

THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY CONTENT IS ACCURATE OR COMPLETE. YOU USE THE SITE AT YOUR OWN RISK. SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY EXCLUSIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

14. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HIDDEN STATS STUDIO AND ITS OWNERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIABILITY LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

15. Indemnification

You agree to indemnify, defend, and hold harmless Hidden Stats Studio and its owners, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Site, your Submissions or creator content, or your violation of these Terms or any law or third-party right.

16. Privacy

Our Privacy Policy explains how we collect, use, and share information in connection with the Site. By using the Site, you acknowledge the practices described there.

17. Governing law

These Terms are governed by the laws of the State of Maine, USA, and applicable U.S. federal law, without regard to conflict-of-laws rules. Subject to Section 18, you agree that the state and federal courts located in the State of Maine have exclusive jurisdiction over any dispute not subject to arbitration, and you consent to personal jurisdiction there. If you access the Site from outside the United States, you do so on your own initiative and are responsible for compliance with local law.

18. Dispute resolution

Informal resolution first. Before filing a claim, you agree to contact us at contact@hiddenstatsstudio.com and try to resolve the dispute informally for at least 30 days.

19. Termination

We may suspend or terminate your access to the Site at any time, with or without notice, for any reason, including if we believe you have violated these Terms. Sections that by their nature should survive termination (including Sections 6, 8, 13–18, and 20) will survive.

20. General terms

Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and us regarding the Site and supersede prior agreements. Severability. If any provision is held unenforceable, the rest remain in effect. No waiver. Our failure to enforce a provision is not a waiver. Assignment. You may not assign these Terms without our consent; we may assign them, including in connection with a merger, acquisition, or sale of assets. Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control. Headings are for convenience only.
